cemetery.rest provides visualization through third-party platforms including VRChat, Minecraft, and others. These platforms are operated independently and governed by their own terms of service.
Third-party platforms may change their terms, restrict access, modify features, or discontinue service without notice. We provide no warranties regarding third-party platforms. Your use of these platforms is solely between you and the platform operator.
cemetery.rest is not responsible for any content, policies, or actions of third-party platforms.
Your memorial is assigned plot coordinates. These coordinates:
cemetery.rest reserves the right to change, reclaim, or reassign plot coordinates at any time, without prior notice, for operational or technical reasons.
In extreme circumstances (content violations, technical requirements, doxxing, harassment), plots may be relocated without notice.
cemetery.rest is a nonprofit organization dedicated to perpetual digital memorialization. All cemetery property, data, and operations remain under cemetery.rest ownership.
The Groundskeeper is a position within cemetery.rest responsible for cemetery operations and maintenance. The Groundskeeper retains full operational authority, including but not limited to:
The Groundskeeper role may be filled by staff, contractors, or volunteers acting under cemetery.rest's authority.
cemetery.rest retains ultimate authority over all cemetery matters including legal decisions, financial operations, service continuity, and major policy changes.
Memorial inscriptions must meet community standards. While some profanity may be acceptable within tasteful context, entries must not:
Content standards are enforced at the Groundskeeper's sole discretion. Entries not meeting standards may be edited, relocated, or removed.
No refunds will be provided for moderated, relocated, or removed content.
Upon donation, you receive a unique edit key (e.g., "bat482#skull91"). This key:

"Buyer's remorse" or "accidental" donations do not qualify for refunds.

If a donation is reversed due to chargeback, payment dispute, or fraud, cemetery.rest reserves the right to remove associated memorial entries, revoke edit keys, and deny future service.
Abuse of payment dispute mechanisms may result in permanent exclusion from cemetery services.

cemetery.rest welcomes artistic contributions from the community. If you donate custom art assets (tombstone designs, environmental elements, etc.):
Donations are donations. Do not contribute work expecting guaranteed use, payment, special privileges, or control over implementation.
By submitting memorial inscriptions or other content to cemetery.rest, you grant cemetery.rest a perpetual, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute that content as part of cemetery operations across all platforms.
You retain the right to use your own inscription text elsewhere.
All cemetery.rest content—including site design, artwork, code, visual assets, 3D models, platform implementations, and interfaces—remains the exclusive property of cemetery.rest.
You may not reproduce, distribute, modify, or create derivative works from cemetery.rest content without written permission.
Memorial entries may be transferable to other users in the future through an official cemetery.rest marketplace. Unofficial transfers:
Official transfer features, when available, will include marketplace fees.
If you, as a guardian, permit a minor (under 18) to use cemetery.rest, you accept sole responsibility for: (a) the minor's conduct on the site, (b) monitoring the minor's access and use, and (c) any consequences of the minor's use.
You agree not to use cemetery.rest, or any information obtained from it, for any unlawful purpose. cemetery.rest, at its sole discretion, shall determine whether any use violates this provision.
Unauthorized access to cemetery.rest systems, databases, or infrastructure constitutes a violation of these terms and may constitute a criminal offense under applicable law.
You agree to indemnify cemetery.rest for any losses caused by your unauthorized access or security breaches.
You agree to defend, indemnify, and hold harmless cemetery.rest, its operators, volunteers, and the Groundskeeper from any claims, damages, or legal fees arising from: (a) your violation of these terms, (b) content you submit that infringes others' rights or violates any law, (c) your misuse of the site or services, or (d) disputes with other users arising from your conduct.
cemetery.rest may modify, suspend, or discontinue any aspect of the site or service at any time without prior notice, including: site availability, features, platform support, visual design, plot layouts, and any user's access to the site.
cemetery.rest reserves the right to refuse service, decline donations, remove content, or revoke access to any person at any time, for any reason, at the Groundskeeper's sole discretion.
cemetery.rest reserves the right to correct any errors made by staff, volunteers, or automated systems, including errors in plot assignment, coordinate designation, or memorial content.
If an error results in incorrect plot assignment, we may transfer your entry to an equivalent location.
cemetery.rest has no obligation to monitor user content. However, we reserve the right to review content and disclose information as necessary to satisfy any law, regulation, or governmental request, or to remove content that violates these terms.
Use of the site constitutes consent to such disclosure when legally required.
We reserve the right to remove and permanently delete your content if it breaches these terms, our guidelines, or any applicable law, or if it negatively impacts the cemetery or other visitors.
To the maximum extent permitted by law:
cemetery.rest disclaims responsibility for loss or damage from causes beyond reasonable control, including but not limited to: platform failures, hosting outages, cyberattacks, vandalism (whether digital or physical), data corruption, force majeure events, natural disasters, war, or actions of third parties.
We may update these terms as cemetery.rest evolves. Changes will be posted at cemetery.rest/terms. Continued use after changes constitutes acceptance.
All memorial entries and donors shall be subject to these terms, and to such amendments, alterations, or additions as may be adopted from time to time.
These terms constitute the entire agreement between you and cemetery.rest regarding your use of the site and services, superseding any prior agreements.
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision does not waive our right to enforce it later.
These terms constitute the sole agreement between you and cemetery.rest. Statements by any volunteer, staff member, Groundskeeper, or representative, unless confirmed in writing by cemetery.rest, shall not be binding.
These terms shall be governed by the laws of the State of Texas.
Any disputes arising from these terms or your use of cemetery.rest shall be resolved exclusively in courts located in Brazos County, Texas. You consent to the jurisdiction of such courts and waive any objection to venue.
